Yemen Houthi Crisis: U.S. and U.K. Airstrikes and Shared Cargo Loss Responsibility

On May 31, 2024, Yahya Saree, the military spokesperson for Yemen's Houthi movement, announced that U.S. and U.K. airstrikes targeted multiple locations in Yemen, including the capital Sanaa and the port city of Hodeidah. These strikes resulted in at least 16 deaths and 42 injuries. Saree accused the U.S. and U.K. of violating international law and committing war crimes by targeting civilian facilities. In response, the Houthi forces attacked the U.S. aircraft carrier USS "Eisenhower"​ 


Legal Principles of Shared Cargo Loss

According to maritime law, specifically the principle of "General Average," all parties with an interest in a voyage (including shipowners and cargo owners) must share the losses and expenses incurred due to extraordinary events like fire or piracy. This principle ensures that costs for salvaging a ship and its cargo are proportionally distributed among all stakeholders. For instance, if a ship encounters severe conditions and some cargo is jettisoned to save the vessel, the losses are shared by all parties involved​ 。



Industry Response and Collaboration

In light of increasing maritime incidents, major maritime insurers and shipping companies have joined initiatives to reduce cargo fires and enhance safety measures. Notably, the UK P&I Club and TT Club are part of the Cargo Fire & Loss Innovation Initiative (CFLII), which aims to leverage technology and best practices to prevent such incidents. This initiative includes early fire detection systems and improved cargo handling procedures​ 。


U.S. and U.K. Airstrikes and Escalation

The U.S. and U.K. conducted extensive airstrikes on Houthi-controlled areas in Yemen, targeting military assets such as missile systems and storage facilities. These actions are part of a broader campaign to curb Houthi attacks on Red Sea shipping lanes. The Pentagon reported that the strikes were aimed at degrading the Houthi's operational capabilities. In retaliation, the Houthi military vowed to continue their operations against U.S. interests in the region。

Through the General Average principle, all stakeholders share the financial burden of such extraordinary events, ensuring fairness and sustainability in shipping. Additionally, industry collaboration and technological innovation are pivotal in enhancing maritime safety and mitigating future risks.
