CMA CGM Container Ship Fire: Maritime Law and Industry Response to Shared Cargo Loss

On Monday, May 27, CMA CGM issued a notice to customers that one of its chartered large container ships, the "NORTHERN JUVENILE," with a capacity of 8,814 TEU, caught fire shortly after departing from the Port of Singapore. According to the shipping trajectory map provided by the official announcement and MarineTraffic, since the fire broke out on May 26, the ship has been stranded in the incident area, approximately 600 nautical miles from Port Klang, Malaysia. The severity of the fire incident is considered to be extremely high。



Legal Principles of Shared Cargo Loss

According to the maritime law principle of "General Average," all parties with an interest in the voyage (including the shipowner and cargo owners) must share the losses and expenses incurred due to certain extraordinary events. Specifically, if a vessel encounters an incident at sea, such as a fire, the costs incurred to save the vessel and cargo are distributed among all interested parties proportionately​ ​.

A classic example of General Average includes situations where a ship's captain decides to jettison some cargo during a severe storm to save the ship and the remaining cargo. Under this principle, the owners of the sacrificed cargo bear the loss, while the shipowner and the other cargo owners share the costs equitably​ ​.
